Mumbai: Yesterday, on 25th April, honourable Bombay High Court granted an anticipatory bail to Rahul Raj Singh, who was booked for the abetting to suicide of Balika Vadhu Actress- Pratyusha Banerjee. The court observed that there is no prima facie evidence showing that the accused has “instigated or intended” the said suicidal death.
While dealing with the anticipatory bail petition filed by actress- Pratyusha’s boyfriend, the honourable Bombay high Court’s Justice Mridula Bhatkar found stated that “from the statements of witnesses, it is clearly seen that harassment and disputes were there between the applicant/accused (Rahul Raj Singh) and the victim (Pratyusha Banerjee). But prima facie, there is nothing on record to show abetment.”
It was pointed that while hearing such application of anticipatory bail, the Court observes that earlier the court of sessions had rejected his plea to get bail, as such the application- Rahul Raj Singh approached the High Court.
Moreover, while granting such anticipatory bail, the Court found imposing some conditions upon the accused- Rahul as he is asked to appear before the Bangur Nagar Police, as that police is investigating the matter, and such visit to the Police should be thrice a week for two weeks.
While ordering the grant of such bail in his favour the court also found stating that, “for an offence to be made out under section 306 (abetment to suicide) of Indian Penal Code, 1860 there should be instigation, intentional aid or an intent that the person should commit suicide.” Thus, the court observed that “it is necessary to show whether the accused had mens rea (intention).”
Moreover, the bench also found hearing the conversation which was made between Rahul Raj and Pratyusha, this being telephonic conversation was recorded on 1st day of April, some time before the said suicide was committed. And it was observed by the Court, that “throughout the conversation, the applicant accused is asking the victim not to take any drastic steps and assured her that he would return home immediately.”
However, in the new development of the case, it was also reported shown by a new agency that the deceased actress may have had a drinking problem and it may have had been under such influence of alcohol she committed suicide.
